When to use nofollow on affiliate links?

Here`s a question that`s been on my mind in trying to figure out how strict one has to be:

Company has blogger affiliates (which are made to be nofollowed to follow Google guidelines), however, if one pushes social media campaigns or infographics or other content not for the express purpose of SEO to those affiliates to help promote them, what would be the approach that doesn`t violate those guidelines:

1) Because they are an affiliate, every single thing, whether affiliate related or not, has to be nofollowed on their site (Thus we need to tell them in advance and monitor their posts to make sure).

2) As long as the blog post isn`t trying to sell/use the affiliate codes in them, then it`s okay if the links are followed (Thus we need to tell them that this is not to be a part of their affiliate program).

3) As long as the blog post and anywhere else on that page isn`t using affiliate codes, then it`s okay if the links are followed (Thus we need to tell them that if they like the content to share, then no affiliate links can be present otherwise they have to nofollow the whole thing).

    Now then that is just the FTC that you're dealing with because then there is the FDA and several others.
    Next you have to think about the Committee for Advertising Practice. They cover advertising here in the UK so they might get cross at something.
    People think it is easy to do business on the internet but it sure as hell aint

    That said, it's enough of a headache having to figure this stuff out for Google (read: search engines) on its own merits. heh.
  • W.E. Jonk: If I understand it correct there is a monetary relationship between the company and the bloggers? If the company doesn't pay for a link it shouldn't be nofollowed. But what is paying for a link? Is sending flowers a paid link? Is paying for hotel/flight to a company event paying? ;

  • Masatake Wasa: It sounds like a scalpel vs machete argument in an odd way. I wouldn't pretend to know what the answer is, but my personal opinion is that it depends on the nature of the blog, rather than the nature of individual links. If a blog's sole or predominant raison d'être can reasonably be surmised as commercial, which is underlined broadly speaking by affiliate schemes, then I'd go for (1). Perhaps I'm excessively cautious.
  • Ian Dixon: http://www.mlmlaw.com/1303ftcdotcomdisclosures.pdf is over 50 pages that is very definitely headache inducing. The headache starts in the main body then worsens when you start on the examples in the appendix.
    BTW I know the site name sounds dodgy but the Feds have everything in the public domain so that just happened to be where I found the information.
    Oh and it is a very good subject to look at +Micah Fisher-Kirshner ;because most people stay away from it. I get confused enough just trying to figure out Britain and the USA ;
