The old law of diminishing returns, and quite possibly negative returns at this stage. It was always destined to fail as they could never determine who created any given link or group of links. ;The other distinguishing feature of Penguin that destined it to failure was the use of aged signals - you simply cant rely on recent signals since this opens a giant barn door for NSEO.
I'll also guess that they wont release sites currently caught so as to leave an added Fear factor (part of their FUD).
I'll hedge slightly by saying they'll no doubt come up with something new, and quite possibly name it Penguin to give the impression of continuity, and/or to release some of the sites at the edge of a current penalty.
Just my $0.02.
