What should you do if a bad/penalized site is linking to you on multiple 404 pages?

Former colleague of mine had an interesting question that I thought would be interesting to the community:

What should you do if a bad/penalized site that is linking to you on multiple pages, yet the pages they are linking to are to new 404s pages?

The part that interests me isn`t the normal answer of "disavow the domain, 404s are dropped from the link graph" but around the site creating a ton (think thousands) of 404 pages linked from a bad domain.?
